1. Acceptance of Terms
These Terms of Service ("Terms") govern your use of the Clarity AI platform and related services ("Service") provided by Lucent Works LLC ("Lucent Works," "we," "us," or "our"), a Colorado limited liability company.
By creating an account, starting a free trial, or using the Service in any way, you agree to these Terms in full. If you are using the Service on behalf of a business, you represent that you have the authority to bind that business to these Terms.
If you do not agree to these Terms, do not use the Service.
2. Description of Services
Clarity is an AI Employee platform that integrates with field service management software (Jobber, Housecall Pro, ServiceTitan, and others) to provide automated AI services including:
- The Booking Manager: AI-powered inbound call handling, lead qualification, and job booking
- The Tech Coach: Technician performance analysis, scorecard generation, and coaching reports
- The Revenue Scout: Proactive customer outreach and revenue gap identification
- The Business CFO: Weekly business intelligence reports and financial performance analysis
The specific services available to you depend on your subscription tier. We reserve the right to modify, expand, or discontinue features at any time, with reasonable notice to active subscribers.
3. Eligibility
You must be at least 18 years old and legally capable of entering a binding contract to use the Service. The Service is intended for use by business owners and operators in the trade contracting industry. By using the Service, you represent that you meet these requirements.
4. Account Registration
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account at aaron@lucentworks.co or 720-807-7281.
You agree to provide accurate, current, and complete information when creating your account and to keep that information updated.
5. Subscription and Payment
Subscription plans: The Service is offered on a month-to-month subscription basis at the pricing tier you select. Current pricing is displayed at lucentworks.co. We reserve the right to change pricing with 30 days advance notice to active subscribers.
Free trial: New subscribers receive a 14-day free trial. No credit card is required to start. At the end of the trial period, you will be asked to provide payment information to continue service. You will not be charged without your explicit authorization.
Billing: Subscriptions are billed monthly in advance. Payment is due at the start of each billing cycle. Failure to pay may result in suspension or termination of the Service.
Cancellation: You may cancel your subscription at any time with no penalty. Upon cancellation, your service will continue through the end of the current paid billing period. No contracts. No cancellation fees.
30-day ROI guarantee: If, in your first 30 days of paid service, the Booking Manager does not convert calls to booked jobs with a combined revenue value exceeding your monthly subscription fee, you may request a full refund. Refund requests must be submitted within 45 days of your first paid charge. We reserve the right to request documentation of job booking records from your FSM to process the refund claim. This guarantee applies to your first subscription period only.
6. SMS Communications Program
The Clarity Booking Manager sends and receives SMS messages on behalf of your business as part of its inbound call handling and follow-up functions. By activating the Booking Manager, you agree to the following terms and authorize Clarity to send SMS messages from or associated with your business phone number(s).
Your obligations as a subscriber: You are responsible for ensuring that your customers have opted in to receive SMS communications from your business before the Booking Manager sends messages to them. You agree to configure the Booking Manager's opt-in prompts accurately and to maintain opt-in records as required by applicable law and your wireless carrier's terms of service.
Prohibited SMS uses: You may not use the Booking Manager or any Clarity SMS functionality to send unsolicited messages, spam, messages to opted-out numbers, or any content that violates applicable law, carrier guidelines, or CTIA messaging principles. Violations may result in immediate termination of your account.
Compliance responsibility: You acknowledge that you are responsible for compliance with all applicable federal and state laws governing commercial SMS communications, including but not limited to the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, and applicable state regulations. Lucent Works provides the technical platform; compliance with communication laws is your responsibility as the business using the Service.
7. Permitted Use
You may use the Service solely for lawful business purposes in connection with your trade contracting business. You agree to use the Service in accordance with these Terms, our Privacy Policy, and all applicable local, state, federal, and international laws and regulations.
8. Prohibited Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law or regulation
- Resell, sublicense, or otherwise provide the Service to third parties without written authorization from Lucent Works
- Attempt to gain unauthorized access to the Service or its underlying infrastructure
- Interfere with or disrupt the integrity or performance of the Service
- Use the Service to send spam, unsolicited communications, or messages to opted-out recipients
- Use the Service in any manner that could harm Lucent Works, other subscribers, or third parties
- Reverse engineer, decompile, or attempt to extract source code from the Service
9. Intellectual Property
Your data: You retain all rights to your business data, customer data, and the information you bring into the Service. Lucent Works does not claim ownership of your data.
Our platform: The Clarity platform, including its software, AI models, workflows, and documentation, is the intellectual property of Lucent Works LLC. These Terms do not grant you any rights to our intellectual property beyond the limited license to use the Service as described herein.
Feedback: If you submit ideas, feature requests, or suggestions to us, you grant Lucent Works the right to use that feedback without restriction or compensation. Feature requests improve the Service for all subscribers.
10. Privacy
Your use of the Service is also governed by our Privacy Policy, available at lucentworks.co/privacy, which is incorporated into these Terms by reference. By using the Service, you agree to the collection and use of your information as described in the Privacy Policy.
11. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. Lucent Works does not warrant that the Service will be uninterrupted, error-free, or that specific results will be achieved.
Business performance results — including call answer rates, average ticket values, and revenue outcomes — depend on many factors beyond the Service, including market conditions, technician performance, and business practices. The statistics referenced in our marketing materials reflect industry research and are not guarantees of specific outcomes for your business.
Lucent Works is not a licensed financial advisor, legal advisor, or regulated professional services firm. Nothing in the Service constitutes professional advice.
12. Limitation of Liability
To the maximum extent permitted by applicable law, Lucent Works LLC and its founder shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or related to your use of or inability to use the Service.
Lucent Works's total liability to you for any claims arising from these Terms or the Service shall not exceed the total subscription fees you paid in the 90 days prior to the claim.
13. Indemnification
You agree to indemnify, defend, and hold harmless Lucent Works LLC and its founder from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your violation of these Terms, or your violation of any applicable law — including without limitation any claims arising from your use of the SMS messaging functionality.
14. Governing Law and Disputes
These Terms are governed by the laws of the State of Colorado, without regard to its conflict of law principles. Any dispute arising from these Terms or the Service shall be resolved through good-faith negotiation between the parties. If negotiation fails, disputes shall be resolved in the state or federal courts located in Adams County, Colorado.
We're a small, founder-operated business. If you have an issue, please contact Aaron directly before pursuing any formal dispute process. Most things can be resolved in a phone call.
15. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will notify active subscribers by email at least 14 days before the changes take effect. Your continued use of the Service after the effective date of updated Terms constitutes your acceptance of the changes.
If you don't agree with an update, you may cancel your subscription before the effective date without penalty.
